Yeah, theO has a strict no fanart policy. My portfolio got purged. Like completely purged. They reported and deleted even the oldest of my wallpapers and cards that had fanart. It really bothers me that I see other people using fanart and nothing happens though. Some people even use other wallpapers from different sites and nothing happens...
Unfortunately I don't think many or any art sites any more give a shit as to whether you credit the artist or not. Apparently getting permission from the artist is the only way you can use their art. I had an incident back in the summer where I accidentally used someone's art because it looked like a screenshot to me so I made a wallpaper from it. Some nasty deviant came after me and told me I needed to credit the artist, so I did, but then she kept complaining and going around telling the whole universe that it was stolen even after I'd credited the artist. People these days are just dumb like that. I know how you feel.
Hm, you do have to be careful. That was brought down for real somewhere couple of months ago. Now everyone is more careful with those and you will actually see rarely fan arts.
If you want to be sure which ones do you use, best to go with minitokyo or animepaper and under the scans, does the trick. You can also find it elsewhere, but in that way it is more tricky.
That is really weird. Even though it is a little bit of an offense to include work that isn't your own (even with credit), I still see a ton of people doing it. Hell, even one of my greeting cards has a fan art picture in it and nothing was said about it.

Just be careful there.
