Don't be, it's easy to not realize something has been published. I've done it myself since it's impossible to know every single artbook that has been published, scanned and posted somewhere on the net.
I didn't think it was either since it is fan art. However looking closer at this I've now seen that it is actually in one of the pivxie artbooks that has been published. Once a work is published like that then they can be used for submissions.
