Juushiro brushed a lock of hair away from her cheek. "She will free from all the pain if the execution falls through.... " He looked back at his quiet friend. "Take care of her while you can." Shunsui nodded and started his descent from the room. Juushiro lingered for a moment and followed.
Shunsui released a long sigh. With that kind of face and kind actions, there's no way Kita's words are true... He approached his sad friend. "I'll take her now," he stated quietly. Juushiro nodded. Shunsui lifted the unconscious girl into his arms bridal style, glancing down at her pale face. "It must have been too much for her," he looked up at Juushiro, "you standing there with that look on your face and her being trapped like this. Something must have burst inside her."
"Kita! What are you-" the pale captain exclaimed as she rushed for him, eyes wide. He raised one hand to defend himself. As her hand latched on his arm, and she began spewing threats, he brushed her hair aside. "Calm down, Kita. It's me. You're not in Las Noches now."
Hidden in her hair, Kido sparked from his finger to her. "Shibireyubi." Kita slumped forward, eyes wide, into his arms, still conscious but unable to move at all.
Juushiro sighed. "I'm sorry, Kita. I didn't act in time." He exchanged a look with his friend, who was watching the scene carefully, dark eyes shrewd. He closed his eyes and placed his hand over Kita's face. Inemuri." Kita passed into the forced slumber. Juushiro continued to pet her hair.
Kita quickly looked to Kyoraku then back to Juushiro. She narrowed her eyes at him gritting her teeth.
"That bastard is playing it off." She thought to herself. Her heart then started to race as she looked around the room. "Where is the real Juushiro!"
She walked quickly over to the importer Juushiro as he stepped back from her. Her eyes burned with the fury of hell as she spoke.
"Where is he?! Stop acting and show yourself! Where is the really Juushiro?! I swear to you Aizen if you have hurt him again I will kill you where you stand!"
She struggled against her restraints around her wrist. You could hear the leather popping and snapping as she bore down on them pulling them apart. Her arms and wrist finally gave as she lunged forward at the imposter.

Juushiro chuckled. "I imagine I do. It took a lot out of me to walk here, but I will manage. There's no reason for anything new to happen with my body." He smiled another strange smile at Kita before coughing into his hand. "After all, I'm safe and sound."
"Woah, woah, woah." Shunsui walked over to Kita and set a hand on her shoulder.
"Even if you've been sentenced, that's no way to talk." He looked back his friend, whose face was carefully expressionless again, making his pallor appear even worse. "I don't believe Yama-jii will have our friend strip the boy of his powers, and even if he did, he'd have no choice in the matter. Now calm down."

Juushiro chuckled quietly at Tsukiro's continued backbone and Renji's anger. It was clear that no matter how harsh Central's unfortunate command was it wasn't going to eat into Seireitei's strength that easily. He looked to his old friend, who caught his eye and retied his hair, biding his time.
Juushiro approached Kita. Her eyes were cast down to the ground and her silver bangs hid her eyes. Reaching over, he caressed her cheek with the back of his hand, slowly lifting her chin to look into her eyes. His lips lifted into a strange smile.
"Look at all the trouble you cause, my lovely Kita." He drew closer to whisper into her ear. "But don't worry. I will fix it for you and the punishment will soon begin."
Juushiro pulled back and smiled quietly at Shunsui. "Thank you for letting me talk to her before taking her, old friend." He turned back to Kita, green eyes glittering. As Renji pushed him forward, Tsukiro's reiatsu snaked up Renji's hand and arm, covering it in ice. Tsukiro didn't look at him as he walked out the door. Kita said nothing to no one as she stood waiting for Kyoraku to come take her back to her cell. Her head hung down and she did not look at or speak to no one.
"So it begins..." She whispered softly to herself.
Yamamoto looked back over his shoulder before exiting. "Leave us to our own affairs, child. One Espada is of no match for the Soul Society. As for the Gods. I am sure they will be pleased to see Sumi released from the trap Aizen has placed her in."
With no other words Yamamoto turned and walked out.
"Forget it. It doesn't matter. They're going to do what they want anyway. I accept my punishment, but I'll warn you, if you kill Kita, there's going to be hell to pay from both the gods and from the arrancar Ulquiorra. Killing her would be signing soul society's death warrant."
Yamamoto shook his head. "The sentencing cannot be undone. Central 46 is in fear of the Seraph and her powers. If Aizen ever did get his hands on her again and were able to use those powers--" He fell silent. "It's best she be put to death so she can return back to the Seraph she was before Aizen got ahold of her." He looked to Tsukiro making no reference to the chance of changing it or not.
"This court is dismissed. Captain Kyoraku, will you please take Kita back to the Maggot's Nest. There she will be held until her execution." Yamamoto bowed to them when he stood. He then turned and left the hall.
Captain Kyoraku grabbed both lieutenants by the scruff of their kimonos and hauled them backwards, eyes expressionless. He patted both their backs, voice solemn. "It's not always up to us, kids. Don't throw your lives away too."
Hisagi's eyes widened as Renji spoke, then he turned his head towards the captain commander.
"Kita has saved my life. A bad person can't accomplish a deed as great as saving a life. When the gods took our zanpakutos and left us to find them. Kita helped me find Kazeshini. She saved me from falling. Kita could have let me fall to my death, but she chose to save me. Now tell me someone like that is meant to be put to death. She doesn't deserve that."
Renji and Hisagi spoke nearly at the same time, "But Head Captain!"
Before Hisagi spoke again, Renji rambled on, leaving Hisagi to keep his mouth sealed.
"You can't do this captain! She didn't kill captain Hitsugaya, she has helped us NUMEROUS times against the arrancars, keeping us safe! She has gave us so much information on Aizen and the arrancars, you don't see the good in her, you weren't there! This is the reason that a lot of us have refused to bring her into the Soul Society, even if we did have direct orders! She isn't bad, just the sights YOU have seen from her are what you call bad. Kita is a loving, good person, she has saved our asses too many times to count!"

Yamamoto sighed and looked down in his lap. His head staying lowered for a few moments before he looked up he started to speak.
"I cannot over look the fact that Ashimitsu assisted the Seraph in her escape. If he had control of his actions or not. Sumi made claim that she was going to return once she realized what she had done was wrong. I am sure at that time if Sumi had her thoughts in order, Ashimitsu had control of himself once more. He again failed to capture the Seraph and bring her back. Which lead to my dispatching Captain Kyoraku for not only her capture and return, but Ashimitsu as well. I am willing to overlook all the other facts. However, the fact remains," Yamamoto looked to Tsukiro.
"You had no fate in the system of Central 46. You helped her escape making her charges more criminal. Which in turn added to the already long list of disobedient actions you had taken before hand."
Yamamoto looked out at the court members. "So I, Yamamoto Shigekuni, hereby sentence 10th Division; 8th Seat, Ashimitsu Tsukiro. Stripped of your rank, powers and Zanpakuto. Furthermore, I hereby banished Ashimitsu Tsukiro from not only the Gotei 13, but from the Soul Society. Never to return."
Yamamoto then looked to Kita. "I am sorry, young lady. Your sentence was handed down days before this meeting." With a sigh Yamamoto looked to the court once more.
"Kita Miyamoto. By order of Central 46, you are sentenced. To death."
Oh dear.... Juushiro waited a moment, assessing the situation and then spoke up.
"Tsukiro was in an unique position which led him to free the seraph. Through his link with Kita, he realized that she did not kill Hitsugaya and when she was caught and still being held for those actions, he acted." He coughed lightly, breathed in, and went on. "I admit that that was a mistake. He should have waited, talked to an officer, his lieutenant or another captain, or appeared at her hearing. However, in my opinion, his actions to do not warrant a capital punishment.
When the Substitute Kurosaki, Lieutenant Abarai, Captain Kyoraku, and myself moved to set Rukia Kuchiki free, when her sentence was wrong, the charges against us were dismissed after Captain Unohana revealed that Sousuke had planned the whole thing. In the aftermath, all those who took action were wounded severely, making the need for further actions to reprimand them unnecessary. The circumstances are similar here.
Kita is, unfortunately," here the pale captain offered her a small apologetic smile before continuing with his argument, "at least partially responsible for Captain Hitsugaya no longer being in control of his body, but he was not killed. Therefore, the crime is not erased as it was in the situation before when Rukia was proved innocent, but the crime has been reduced; therefore the punishment for eighth seat Tsukiro Ashimitsu and Kita the Seraph should be reduced."
"Tsukiro Ashimitsu is uninjured and should be punished for not going through the right avenues, but the worst that should happen here is a loss of rank or even moving him to another squad for a disciplinary period." A second cough caught him, forcing him to double over, but it subsided a moment later. He talked on. "Kita is the seraph and holds a deep connection with Guardian, proven even more by his words when he rescued me, and Toshiro Hitsugaya is the Guardian. If we are to retrieve our captain, we need Kita on our side. Let her help us retrieve him. She can undo her mistake."
He halted then said in a firm but polite voice. "I believe that capital punishment shouldn't be in consideration in this matter."

Yamamoto grumbled under his breath at her blanten tone. "You are not helping your case, young lady. When ask a direct question I expect a direct answer. Your life, and the life of Ashimitsu hangs in the balance after all."
Yamamoto looked up at the others. "Is there anyone else that would like to add to testimony in their innocents? It seems the Seraph is only digging herself deep."

Kita smiled and looked at the Old Man. "You know of one. What would it matter if I told you of the others. I only have to have a connection with them." She paused then the thought of Gin appearing in Soul Society flashed before her. " And no. I was not the one that brought Ichimaru here. He did that on his own. After all, he was your Captain of the Intelligence's Division. I think he knows all the trick of the trade."
Yamamoto noticed a few looks on the faces of the ones in the room with Kita's statement of punishing the other wrong doers as well. However, before he could speak, Renji entered the room explaining his late arrival. Yamamoto nodded at Renji watching him take his place with the others. Once everything was back in order Kyoraku spoke up.
Listening carefully he nodded, then looked to the Seraph. "You say you have the power to pull people from a dream. Who are these 3 people?"
Shunsui chuckled quietly, muttering under his breath again, "Way to make waves at your hearing, goddess."
The captain offered Kita a sad smile. "He doesn't stand here accused for those actions. I arrested him for helping in your escape. Those are the actions that others, not you, need to find a weakness in or erase to get him pardoned."
He raised his head to his old teacher. "Ashimitsu has been accused for helping the seraph escape and the injury of the guards at her prison. I don't believe the injury to the guards needs to added to his capital crime of aiding a supposed criminal. Kita claims that he was under her control at that point, which makes his actions instinctual. As a former member of the Stealth Force, taking harsh actions towards others in his way was only natural. That division has acted before asking on more than one occasion. It is their way. He came willingly and without a fight when I stood before him and he was in control again. I think those differences should be taken in account.
He bowed his head to Yama and nodded to his old friend. "There's more I know shouldn't be forgotten when sentencing Tsukiro, but I'll see if there's anything else others want to add first."

Renji made haste walking into the captain's hall, slightly out of breath.
He bowed to the Captain Commander, "Excuse my late arrival, it took longer than expected to get my clearance to return back from the Human Realm. I, Lieutenant Abarai of Division 6 is here on behalf of the judgement on Ashimitsu and Miyamoto."

Kita waited for several seconds before she looked up and at Yamamoto.
“Captain Commander, I don’t care if I have a right to speak here or not, but I am going to say my piece in this.” She looked to Tsukiro and smiled weakly. “I know the things Tsukiro is being blamed for are all my fault.” She then looked to Yamamoto. “He had no control over his actions. I called him forth to break me out of my cell while being held in the First division. This was not the first time I had done this with him. Previous while I was in Las Noches I called him there to save me from Aizen’s wreath when he was beating me senseless. He saved not only me that day, but Miss Orihime Inoue as well. I know you see what he had done was against your orders.”
She paused casting her eyes down closing them as she thought to herself. “Please forgive me my friends.” She then looked back up at Yamamoto.
“Should you not have all the other officers and lieutenants that know me called in and placed under trial as well. For they never followed the order either in bringing me in. Captain Hitsugaya, being the most notorious of the offenders when he hid me in the Godly realm away from the Soul Society as well as Las Noches.”
Yamamoto looked at the one’s that now occupied the room with him. Saying nothing to Juushiro’s vocalizations on the account he took forth the next action.
“I will take pleas on the behalf of 8th Seat; Tenth Division, Ashimitsu Tsukiro. If you have evidence on his behalf, of why, he should not be accused for his transgressions. I will hear them.”
"I don't think she would like you to forget her name, Shunsui," he whispered in turn before once again stepping away to speak to the assembly.
"I don't think Tsukiro aggravated Captain Hitsugaya's mission any more than us sending him there in the first place. We did not know he was the Guardian." He coughed quietly. Breathing in, he went on. "Tsukiro's actions protecting the Seraph before the order brought him into more contact with Captain Hitsugaya and maintained the bond of a division and their captain as long as possible," he smiled, "keeping the Guardian from complete control." He paused to catch his breath.
"Tsukiro was furious at the time of the order. He would have taken her in if had the opportunity; however, the truth was revealed to him. After that, if he had continued, it would have been the same as before with Kurosaki and his friends, a wrong judgement call which could have resulted in something unfortunate."

Shunsui winced and lowered his head, muttering out of the corner of his mouth. "You never told me we were dealing with a reckless streak similar to the cat lady, Juushiro."
"How about this? Instead of worrying about someone who's powers Aizen can't even exploit, how about you spend more time worrying about Aizen himself. The only reason Kita is trouble with you is because of Aizen's greed and lust for power. He had the human Kita killed and turned into an arrancar, yet still she is useless to him. You're wasting time on us when you could be head hunting Aizen. If anything, you should be asking her for help. So don't patronize me about making Hitsugaya's job harder. Oh, and for the record, Aizen had a hand in my family's murder, so I resent you accusing me of working for him."

Yamamoto gruffed at Juushiro's comment then looked Tsukiro’s way. “Tell me, is your orders as eight seat of squad ten any different than the orders of any other soul reaper in the Gotei 13. She was to be captured and brought here. Your Captain was sent into the lions den to retrieve her and because of all the interference from you and all the others that were trying to protect her. You caused Captain Hitsugaya great conflict in her capture. Is it not your duty to make your captains job easier or were you secretly working for Sousuke?”

Yamamoto opened one eye looking at her. "Tsukiro will not be arbitrated by his friendship with you. The poor decisions he made in your company is what he will be tried upon.”
Yamamoto raised a brow seeing Hisagi enter the room. "Lieutenant Hisagi, what is your reasoning for attending this hearing?" His gruff voice filling the silence of the room.
Yamamoto nodded and remained seated his hands resting to the top of his staff. A small sigh escaped him as his mind coursed over the up and coming events. So caught up in his thoughts he did not see Juushiro walk in.
He knew of the verdicts Central had already come up with , his only hope now was Juushiro's evidence for Kita and Tsukiro was strong enough to change their minds.
Hearing the cough Yamamoto looked up seeing Juushiro enter the room. He nodded slightly to him as he walked over to stand next to Kyoraku.

A pale Juushiro entered slowly, halting at the threshold to catch his breath from another cough before passing through. Shunsui nodded his way and he returned it. When his old friend rose an eyebrow at the perspiration on his brow, he chuckled shortly and continued walking. He paused at the two condemned. Touching both of their shoulders, he offered them the glimmer of an encouraging smile before joining Shunsui.
Juushiro lowered his head to Yamamoto. "Thank you for waiting for me, Sensei," he murmured politely.
Yamamoto looked to Tsukiro and then to Kita as they both stood before him and their peers for judgment. Only one more he figured would show in their defence and giving a little more time for his appearance was something he was will to give. He looked to Kyoraku and nodded to him.
Back in his study at sixth division, Byakuya paused at his work. Soon enough, the fate of the boy and the seraph would be public knowledge. He continued scripting his signature.
Tsukiro struggled to keep his composure. On one hand he was angry with Kita, but on the other his heart swelled when he felt her enter the room. Yet more than anything he was scared for her. He kept his blank, emotionless mask over him and kept his head up. Even then, he had no regrets.
Walking in Kita looked to Tsukiro as her heart lifted, but fell quickly. His eyes had lost the sparkle she remembered the last time she saw him. She cast her eyes from him and continued her path forward. Holding no ill will against the Captain Commander; Kita bowed her head slightly to him before she was placed before the others.

The guards at the great doors stepped aside as Captain Kyoraku entered, Kita the Seraph before him. Silently, Captain Kyoraku walked her up to where Yamamoto waited at the head of the room. The Ashimitsu kid and his guards stood on the Captain Commander's other side. Shunsui couldn't help but realize that the old man looked his age. Sighing, he bowed his head at Yama-jii and stepped back a pace as expected. Folding his arms into his kimono sleeves, he waited for the ordeal to start.
Tsukiro hiked up the stairs to the first division barracks, accompanied by two guards from sixth division. It was nice to finally have some fresh air and a change of scenery after being locked in the sixth division barracks for so long.
As they walked into the captain's hall, he kept his head held high, despite his situation. He was ready for whatever they decided.

"This court is dismissed. Captain Kyoraku, will you please take Kita back to the Maggot's Nest. There she will be held until her execution." Yamamoto bowed to them when he stood. He then turned and left the hall.

She saved me from falling. Kita could have let me fall to my death, but she chose to save me. Now tell me someone like that is meant to be put to death. She doesn't deserve that."

@ALL RPers:
