that's such a problem to me! too many ppl don't report the pieces! they know it's stolen, they know who the original artist is, and yet they're too afraid to get involved. i've been speaking to a numbe rof ppl about this because of this incident, and i'm leanring more and mroe that ppl assosiate getting invovled as "getting involved in the drama" associated to the art thief :( i'm trying to tell ppl you can quietly do the right thing and report the piece! you don't and shouldn't say a word to the artthief! simply do the right thing, report the piece and supply a link to the orignal.
i wish more ppl understood this. i can't understand why they haven't realized this already... you might be right. they might assume that someone else will take care of it. but the same way there are ppl like myself who quickly report pieces that are inappropriate for the site or are stolen/plagarised, there are many ppl who do nothing. so, for one to say "i won't gen involved. someone else will" there's another coming by thinking the same thing.
i think it needs to be emphasised on the site that we can "silently do the right thing" and help rid the community of art thieves (rather than rally together and start a riot ^ __ ^;; )

That's one thing that always baffles me a bit. I'll come across blogs where people are upset and complaining and assuming nothing is done, but since I handle submission reports, I know that in many of those instances, no one did step forward. Perhaps they assumed someone else would.

Until today, after this deal came up, no one ever reported the issue surrounding WiNtErLeAf, so in that case, wishing more was done is rather pointless since to be blunt, no one moderator is going to be familiar enough with every single piece of art on the net to instantly realize something was ripped. This is why we have a reporting system so members can easily notify us if something has been stolen.
Also, when you are dealing with a case like yours, where both of you could have taken it from official art references, it's not as simple and therefore I have to look at it more carefully. Plus, it was reported, on the 7th, which is a holiday, so feeling like nothing happened, is a bit premature since you honestly don't know if I've reviewed it yet or if I'm looking into it or not.
It's a baseless assumption that seems to be stemming from impatience and I'm sure the quicker response to the other 'original art' doesn't help since it then gives the illusion that nothing is being done, when that's simply not true at all.
This is where I'm going to tell you that patience and realizing that staff doesn't live online is something you and everyone else should keep in mind when they start thinking 'nothing was done'

If this is truly the case, why has no one, until around the 7th of this month when the first report was put in, ever bothered to report it? The only thing I have seen on this member, before the current reports that I'm still checking out.. was a case where they referenced the cover of a Bleach CD, which is considered acceptable since referencing official art is allowed.
If someone really is ripping from more original art like what you did, vs using the same reference of something official, then all that needs to be done is having someone report it.
Since I personally handle all of the submission reports, I know for a fact that no one has done this. So though you may have wanted others to know, what good does that do if the one person who can do something about it, doesn't know a thing?
Mind you I'm talking about more than just your image. If this is a pattern and you or anyone else has definite proof, then by all means, it's worth taking the time to properly report each one.
If there is a lot, it might take some time to completely check it out, but everything that comes my way is carefully considered and if warranted, action is taken.

i know you're right...this sort of thing should be kept private, but i really wanted ppl to know my view on this. a lot of ppl reference but not enough ppl ask permission from their fellow artists they reference FROM. it's flattering when someone enjoys your work enough to want to draw it, however, it's insulting when a "Refernecer" (i'll call them) denies that they even saw your work while creating their obvious copy :( if an artist has inspired you to create a piece, they deserve some credit for inspiring you. i feel it's only fair.

see, i did that when i was younger (and STILL DO THAT with the artists permission!!) i make SURE that if a photo imspired me that i ask the artists permission to sue it. when it's posted i notify the artist AND a make sure that the first few lines of my artist comments state that it was referenced. the artist who inspired me deserves the credit too ; U ;
referencing is a wonderful way to improve and learn how your favorite artists work! how else will we be able to improve? practice really does make perfect :D
HOWEVER, what they're doing is just wrong, especially when she's stealing from non-professionals; ppl who aren't known like you and i and they can easily claim our ideas and noone would be the wiser!!

Sure you might be nice enough to avoid personal attacks, but not everyone is that considerate. Plus, by linking to the work in question, more people end up reporting it than is necessary.
So long as I have the proper links and information given in a report, that's all I need. I don't need more than one. The others are a complete waste of my time since I have to close them all out.

I don't have a problem with you or any artist wanting their stuff to be referenced, after all that's fair. Most of the work on the site isn't directly referenced on account of the fact that putting it in the correct category is an indirect reference stating that they aren't the original creator of the characters.
Anyway, as much as it might frustrate you, or any other artist that your work was used without permission, openly posting and pointing to the member and creating a fan art out of anger solves nothing.
If this should happen again, report it, walk away and actually give us time to respond to the report. Not only will that make my job a lot easier, but it will keep you from getting in trouble as well. :/
Well, when they first joined I thought their work was so insanely good...frankly I was a bit jealous LOL. But then as I kept realizing I had SEEN everything they were drawing...I realized they were references. T.T From the Bleach Manga...or from this or that. You are right, they have talent and should try to put it into their own work!! But at this rate...it's just practically copying something from sight. I do that myself to practice. I'll draw certain anime scenes or positions...just to improve you know? But it's not like I go and claim them >3>' I make meh own characters :P

I can totally understand your point since you already know where I stand on this. Sadly that one remark she left contridicted herself after what you said to her and yet again you got her with her statements.
I just believe right now that the proper authorities will take action on this and will do the right thing. Hopefully she will take all the works down from other people. That would be the smart thing to do.

my goodness!!! that's so incredibly irritating!!!!! the chances are that kid doesn't even draw anymore. a similar thing happened to me in gradeschool, and the kid no longer drew once they drew older. kids who do things like that don't usually have any talent and therefore will claim work that isn't their own.

it's nothing about it being "nice" to have credited me, my work is copywritten. if i truly wanted to i could sue LOL my work is being used for a publication. by federal law, no one can use my work or draw anything from it WITHOUT my consent.

I agree they should have credit for you. And I would give you credit and ask for your permission to copy a pose of yours. The only thing I can think of as to why he/she would steal your pose because your very very very talented, but I'd still ask.
I hope it get resolved soon too.
When I look back, I remembered that some third grader stole my art. She stole my character Tetsu Toshimori. My friend told me that she was flying everywhere telling people she drew it. But I don't think I did anything to stop her. All I did was get mad. I feel pathetic that I didn't tell her to give me credit or to not steal my art.
But now, I'm over 100 miles away from her. So she won't steal my art ever again. Hopefully. lol

of course that's plagarism. if you quote from a book in your report in college without stating where the quote was from, you can be reported for plagarism. copywritten work (such as my artwork) that is referenced this heavily is ILLEGAL, and ppl can be sued for ding things like this in the real world (as in, if their pplagarised work was used in a publication)

i did, and i even left a comment under the pic with a link to the original. i don't mind ppl referencing my work...but i should hope that they would respect my art enough and respect the fact that my work inspired them enough to give me FULL credit!! any time i wanted to reference a photo I ASKED THE ARTIST FIRST!! if they said no, i wouldn't do it. if they said i could (and usually they're very excited about seeing what i come up with) i make SURE to have the first lines of my artist comments saying "this was referenced off of a photo by [artist name and link to pic HERE]" and i THANK THE ARTIST for allowing to reference their art work!!

If someone DID go that far and claim my chara, and published it, I'd be screwed. Because I haven't published any of my charas. I'm hoping to soon tho. I'm writing a story that I want to publish.

i know you're right...this sort of thing should be kept private, but i really wanted ppl to know my view on this. a lot of ppl reference but not enough ppl ask permission from their fellow artists they reference FROM. it's flattering when someone enjoys your work enough to want to draw it, however, it's insulting when a "Refernecer" (i'll call them) denies that they even saw your work while creating their obvious copy :( if an artist has inspired you to create a piece, they deserve some credit for inspiring you. i feel it's only fair.
i wanted ppl to know that the piece they were seeing floating about the populars was a rip off of my piece. i'm sorry for making this so public. i hope nothing unecassary happened. i made SURE to say i didn't want anyone attacking the artist, i simply wanted them to know where i stand on such a matter is all. and its known that this person references off of so MANY fellow artists here on TheO and on DeviantART.com! i didn't want to link back to each of their pieces. that's too time consuming...but i felt ppl needed to know. i might be wrong for thinking so, and i appologize.

see, i did that when i was younger (and STILL DO THAT with the artists permission!!) i make SURE that if a photo imspired me that i ask the artists permission to sue it. when it's posted i notify the artist AND a make sure that the first few lines of my artist comments state that it was referenced. the artist who inspired me deserves the credit too ; U ;
referencing is a wonderful way to improve and learn how your favorite artists work! how else will we be able to improve? practice really does make perfect :D
HOWEVER, what they're doing is just wrong, especially when she's stealing from non-professionals; ppl who aren't known like you and i and they can easily claim our ideas and noone would be the wiser!!
it's simply wrong!!

I actually prefer to keep discussions about this kind of thing to PM's since it avoids unnecessary drama, but since you openly posted this, I will openly respond to it.
it was brought to my attention that someone has heavily referenced / copied one of my pieces...; __ ;
In truth, this is where it should have simply been turned over to staff and left alone. Not that you can't post about it, but you've made a number of glaring mistakes in how you've responded to finding out that someone used your work. One of them is this:

You openly listed, via a link, which member had used your work without permission. Another is this bit here:

Disclaimers do not absolve you of the responsiblity of your actions. Bottom line, this is our job not yours and back seat moderating, even if well intended, is something we don't need.
Sure you might be nice enough to avoid personal attacks, but not everyone is that considerate. Plus, by linking to the work in question, more people end up reporting it than is necessary.
So long as I have the proper links and information given in a report, that's all I need. I don't need more than one. The others are a complete waste of my time since I have to close them all out.
the thing is this wouldn't have bothered me at ALL if i was alteast asked or given credit. everyone learns by referencing but...they reference / copy so often and never give credit...
Again, this goes back to dealing with issues like this, being our job, not yours or any other member. We've provided the tools for you to report it so we can deal with it and make a decision based on the severity of the incident.

And you just made the same mistake again, linking directly to the person's art and thus drawing attention to them. As for this last bit of your post:

I don't have a problem with you or any artist wanting their stuff to be referenced, after all that's fair. Most of the work on the site isn't directly referenced on account of the fact that putting it in the correct category is an indirect reference stating that they aren't the original creator of the characters.
Anyway, as much as it might frustrate you, or any other artist that your work was used without permission, openly posting and pointing to the member and creating a fan art out of anger solves nothing.
If this should happen again, report it, walk away and actually give us time to respond to the report. Not only will that make my job a lot easier, but it will keep you from getting in trouble as well. :/

Well, when they first joined I thought their work was so insanely good...frankly I was a bit jealous LOL. But then as I kept realizing I had SEEN everything they were drawing...I realized they were references. T.T From the Bleach Manga...or from this or that. You are right, they have talent and should try to put it into their own work!! But at this rate...it's just practically copying something from sight. I do that myself to practice. I'll draw certain anime scenes or positions...just to improve you know? But it's not like I go and claim them >3>' I make meh own characters :P
Again...so sorry that happened to u. I may not be much...but you have my support too ^^;;.

LOL i know. this person is seriously such a fool. saying one thing and then countering saying something that's a total contridiction. that WOULD be the smart thing to do, but they won't do it.
not without the amdins taking it down for them.
i wish i knew every piece they stole from others. i'd report them all. perhaps that would be enoough for them to REALLY take it seriously.

I can totally understand your point since you already know where I stand on this. Sadly that one remark she left contridicted herself after what you said to her and yet again you got her with her statements.
I just believe right now that the proper authorities will take action on this and will do the right thing. Hopefully she will take all the works down from other people. That would be the smart thing to do.

my goodness!!! that's so incredibly irritating!!!!! the chances are that kid doesn't even draw anymore. a similar thing happened to me in gradeschool, and the kid no longer drew once they drew older. kids who do things like that don't usually have any talent and therefore will claim work that isn't their own.
that's the sad truth :( if worse comes to worse, you can alwasy copyright your artwork of that character. o doubt they did anything like that to claim him <3 WHO would go that far?! LOL

in the real word, ppl are taken to court for doing what this artist did.
well...i honestly go as far as to say they are a great artist ^ - ^;; most of their work is heavily referenced. that doesn't really show any paticular skill what so ever :( they have some sort of talent, but they need to use it properly, if they see a piece they want to use they need to ask permission, and CREDIT the artists who have inspired them.
dedicate it to me?? i wouldn't have been pleased with that at ALL! i mean, come on. it's not a piece that was drawn in my "honor"...it was something completely based off of my work! there's a great difference, hun :(

I agree they should have credit for you. And I would give you credit and ask for your permission to copy a pose of yours. The only thing I can think of as to why he/she would steal your pose because your very very very talented, but I'd still ask.
I hope it get resolved soon too.
When I look back, I remembered that some third grader stole my art. She stole my character Tetsu Toshimori. My friend told me that she was flying everywhere telling people she drew it. But I don't think I did anything to stop her. All I did was get mad. I feel pathetic that I didn't tell her to give me credit or to not steal my art.
But now, I'm over 100 miles away from her. So she won't steal my art ever again. Hopefully. lol

that's how i do things, and i should hope others will do the same.
i don't want ppl to go attacking this artist, BUT i hope that ppl can learn something from this...

of course that's plagarism. if you quote from a book in your report in college without stating where the quote was from, you can be reported for plagarism. copywritten work (such as my artwork) that is referenced this heavily is ILLEGAL, and ppl can be sued for ding things like this in the real world (as in, if their pplagarised work was used in a publication)
if you knew that the work they've drawn in the past was so heaivly referenced and they never gave credit or added links to the original (like so MANY artists do) why didn't you say something?

i did, and i even left a comment under the pic with a link to the original. i don't mind ppl referencing my work...but i should hope that they would respect my art enough and respect the fact that my work inspired them enough to give me FULL credit!! any time i wanted to reference a photo I ASKED THE ARTIST FIRST!! if they said no, i wouldn't do it. if they said i could (and usually they're very excited about seeing what i come up with) i make SURE to have the first lines of my artist comments saying "this was referenced off of a photo by [artist name and link to pic HERE]" and i THANK THE ARTIST for allowing to reference their art work!!

Yes, again! Should we report these people!! TT.TT I'm not good at reporting people, every time I realize somebody HEAVILY referenced somebody's picture or posted somebody else's picture, I always hesitate to report them...ehe...
That Fried Rice picture was my favorite of yours!! TT.TT I was so mad when I saw them post that! Yours still looks WAAY better. Also, I noticed the same artist referenced several other drawings including the Pandora Hearts OST cover...
Not mad at them, just noticing things.
I didn't know that also counted as plagarism, and I didn't know that you didn't allow them to do that!
